Why do attorneys feel it necessary to push clients OUT OF mediation?

While I generally try to avoid lawyer bashing (especially since they are my people…) there are some out there (out there being San Diego) that are REALLY toxic! I have had two mediation clients in the last month where their consulting attorneys have advised them to get out of mediation and take it to litigation! WHAT?? In this day and age, where (1) the courts are terribly congested and (2) most families DO NOT have money to enter litigation that will last anywhere from 1 year to 5 years, WHY WHY WHY would an attorney, a professional, one who has taken an oath to be ethical, find it GOOD advice to take a party out of a process where they can make their own choices and decisions and save money and insert them into the emotional turmoil that comes with litigation….MONEY! That is the ONLY reason that would make any sense at all.

While there are obviously bad mediators that can negatively affect a couple going through a divorce, there are 20 times that amount of crappy attorneys who will also damage the case, not out of their inability, but out of lack of caring. Families do not belong in the court system….they just dont….it is a waste of time, money, energy, everything. Every bit of research, writing, articles, etc., will tell you, if you can mediate, DO IT! So what are you waiting for???? DO IT! Back away from the attorney’s office…
